		Preamble.
		The RISC Analysis applications include RISC Analysis and RISC Analysis Online. RISC Analysis is a stand alone software application which is locally installable on a personal computer or workstation.  RISC Analysis Online is the internet based equivalent of the locally installable software.
		Ownership.
		The owner of both RISC Analysis products is Windgate Software LLC.  In granting a user permission to access RISC Analysis Online, Windgate Softaware LLC does not transfer ownership of any part of RISC Analysis Online to the user.  Both applications are licensed on a per user basis.  RISC Analysis ships with it's own End User License Agreement.
		Outside Links.
		RISC Analysis Online includes links to various domains outside of the RISC Analysis URL including various IBM resources.  Outside links often contain copyrighted materials.  By accessing domains via links in RISC Analysis Online, copyright ownership is not transferred or implied by the owners of any such materials.  Windgate Softaware LLC is not responsible for the material and content of outside links.
		Public and Secured Sections.
		RISC Analysis Online contains two distinct and separate sections.  One section is freely accessible to the public and the other is not (secured).  The public section may be linked to, copied, or in any other way disseminated by any user whether registered or not. The secured section is only available to registered users.  The secure section is  accessed via a Login ID and Password which are provided by Windgate Softaware LLC to registered users.  Registered Users are defined as: Clients with a current, active and paid for subscription.  Clients to whom we have issued a temporary evaluation account. Clients to whom we have issued a non time based gratis account which is revocable at our discretion. Data contained within the secured section of RISC Analysis may not be copied to a web site nor disseminated to third parties beyond the scope of normal business purposes.  For example,  PNs/FRUs and their related descriptions may be listed on a web site for general inventory purposes.  However, wholesale coping of the PN/FRU data, Feature or Machine data etc. is strictly prohibited. 		Transfer of License - Protecting User Login ID & Password.
		User Licenses may not be transferred, sold, rented, loaned or in any other way passed on to third parties.  This especially includes giving third party or non subscribers access to RISC Analysis Online by releasing the Login ID and password.  It is the responsibility of the licensee to ensure the confidentiality of the  Login ID and passwords.
		Duration of License.
		User Licenses are time based from one month to one year depending upon the service subscribed for.
		Violations of Terms of Use.
		Licenses may be revoked by Windgate Softaware LLC for serious and repeated violations of the terms of use.  Users facing revocation of license for violations of the terms of use will be notified of the violation and given an opportunity to refrain from the violating action before the termination of any account.  In the event an account is terminated as a result of a violation of the terms of use, if the termination occurs before the end of the original license period, refunds will not be given under any circumstances.  We consider it to be a serious violation of the terms of use if the Login ID and Password are released to third parties - regardless of whether they are registered users or not.  Any third party wishing to gain access to the secured section of RISC Analysis Online must contact Windgate Softaware LLC for an evaluation account.  There are no exceptions to this. We consider it to be a serious violation of the terms of use if any attempt is made to access RISC Analysis Online by circumventing the Login ID and Password.  This is considered to be Hacking.  Hacking is illegal and will be prosecuted to the fullest extent under the law.
		Errors and Omissions.
		RISC Analysis and RISC Analysis Online are vast undertakings which provide data and information regarding IBM RS/6000 systems. These systems are constantly evolving and changing.  Information in the RISC Analysis applications is culled from a variety of industry sources, including IBM.  While every effort is made to ensure accuracy of data provided, from time to time inaccuracies may occur.   Windgate Softaware LLC accepts no responsibility or liability for inaccuracies which may exist in the application.  By using RISC Analysis online, you accept and agree that Windgate Softaware LLC, it's subsidiaries, employees and partners are held harmless in the event of data errors.
		User Data Gathering.  (Statement of Confidentiality).
		Windgate Softaware LLC records data concerning usage.  For the public section, this is a hit counter and nothing more.  For the secured section, the data recorded includes only the following information. Data Type Reason User ID & Password Admin. & security purposes Date and time of login Admin. purposes Date and time of update file download Admin. purposes User system IP address Admin. & security purposes User operating system Problem determination purposes User browser employed Problem determination purposes Dual use attempts Problem determination & security purposes Data concerning client information includes only that data required for the normal transaction of business such as name, address, contact info etc.  No data retained by Windgate Softaware LLC is ever released to third parties.
